Applicability, Exceptions, and Consequences

This corporate procedure applies to all Members of the Workforce who have ES&H concerns to report, wish to provide suggestions for improvement, and want their concerns addressed without fear of adverse consequences.

Granting or permitting exceptions or violations of policy, process, or procedure without authority, regardless of position or title, may be cause for disciplinary action up to and including termination of employment. Procedure Overview

This procedure describes the requirements for implementing worker protection for any DOE contractor employee reporting an ES&H concern. 

Procedure Requirements

Activity Responsible Individual Required Action
Create Environment for Reporting Managers

Ensure that:

  • Individuals are advised that they have the right and responsibility to raise ES&H concerns or make suggestions for ES&H improvements without fear of adverse consequences.
  • Leaders can address all individuals’ concerns.
Post DOE Worker Protection Posters Senior Managers

Ensure that the appropriate DOE worker protection poster for information and reporting processes (i.e., “Worker Protection for DOE Contractor Employees") is conspicuously posted along major personnel traffic routes in common use areas of buildings.

Note: Senior managers may enlist assistance from building ES&H coordinators, ES&H coordinators, and building managers.  When there is no senior manager or line manager, coordination is necessary between facilities and the affected organizations to assign a building ES&H coordinator or ES&H coordinator to perform the function.

Respond to Threats or Penalties Managers Do not discharge, demote, coerce, threaten, penalize, discriminate against, or reduce the pay of any individual for reporting a concern.
Assist When Necessary Members of the Workforce

Ensure that Members of the Workforce:

  • Assist DOE in resolution of employee concerns in a manner that protects the health and safety of both employees and the public and ensure effective and efficient operation of the DOE-related activities under their jurisdiction.
  • Cooperate with assessments used to verify action to minimize, correct, or prevent recurrences of a situation that precipitated a valid concern.
